Article 1: Application and modification of the Terms and Conditions

 

The present general conditions of sale apply to all orders placed thru Internet site www.cutprotect.com

CutProtect reserves the possibility of adapting or modifying constantly the present Terms and Conditions. In the event of modification, it will be applied to each order the Terms and Conditions in force at the day of the order.

 

 

Article 2: Availability of the products

 

Our offers of products and prices are valid as long as they are visible on the site, within the limit of stocks available.

 

When receiving your order, we check the availability of the product ordered. In the event of unavailability, we commit ourselves in the 30 days as from the validation of the order either delivering the ordered product to you, or proceed of a refund by transfer on an account indicated by you by mail to the address indicated article 11.

 

In order to manage your request correctly, we need the number of your order and your complete address.

 

The validation date of the order corresponds to the date of the on line payment.

 

 

Article 3: Validation of the orders and electronic signature

 

Purchase order signed by the consumer by "double click" constitutes an irrevocable acceptance which can be modified only within the limits of the present general conditions of sale.

 

The "double click" associated with the procedure of authentification, the non renunciation and the protection of the integrity of the messages, constitutes an electronic signature. This electronic signature has value between the parts as well as a handwritten signature.

 

 

Article 4: Price

 

CutProtect reserves the right to modify its prices constantly but is committed applying the tariffs in force which will have been indicated to you at the time of your order.

 

 

Article 5: Payment and Security

 

Payments are done by bank card.

 

Payment is carried out on protected banking site. This implies that no banking information concerning you is forwarded to the site of CutProtect.com. The payment by bank card is perfectly protected; your order will be recorded and validated by protected banking site.

Security

The information’s concerning your credit card are encrypted under SSL (Secure Socket Layer) protocol and will never appear on the network. The payment is directly carried out to the bank.

In no case CutProtect can have access to this information’s, and do not keep them on its servers. This is why you will be asked to input this information’s at each time you will purchase on our site.

 

Clause of reserve of property

The products remain the property of CutProtect until the complete payment of the order to CutProtect. However, as time of the reception of the order from the customer, the risks of the delivered goods are transferred to the customer.

 

Non-payment

CutProtect reserves the right to refuse to carry out a delivery or to deliver an order emanating from a consumer who would not have paid completely or partially a preceding order or with which a litigation of payment would be in process.

 

Controls

CutProtect controls all the orders which are validated on its site. These controls aim to protect CutProtect from abuses operation by defrauders.

For an order which presents an address of delivery different from the billing address, our services could be brought to contact the two people mentioned; the person attached to the billing address and the one indicated for the address of delivery. Within this framework of procedures, our services could be brought to require all the information’s necessary from you to handle your order: proof of residence and withholding of bank card, but also justifying of residence of the person indicated for the address of delivery, etc.

These requests are made at our choice by electronic mail, simple mail or registred mail.

 

The information’s provided within the purchase order are subject of an automated processing of data. This automated processing of data has as a finality to define a level of analysis of a transaction and to fight against the bank card fraud.

 

 

Article 6: Delivery and delay

The products are delivered to the address of delivery that you indicated to us during the process of order.

 

Times to prepare the order

The necessary time to prepare your order is two to four working days.

The time indicated is an average time and corresponds to the times of treatment, preparation and forwarding of your order (left warehouses). It runs at the time validation of the order.

Then, it is necessary to add the delivery period of the handler (Post).

 

Delivery periods

The ordered product is delivered by the postal circuit to the address being reproduced on the purchase order. Delivery delay thus depends exclusively on the post office.

 

Article 7: Responsibilities

 

CutProtect could not be held responsible in case of non execution of the concluded contract, due to an event out of its control and in particular in the event of strike of the mail service, of handlers, and catastrophes as floods or fires. In case that the products are bought to satisfy a professional need, CutProtect will not accept any responsibility for all consequential damages from this contract, trading loss, loss of profit, damage or expenses, which could occur.

The choice and the purchase of a product or a service are placed under the single responsibility of the customer. Total or partial impossibility to use the products in particular due to incompatibility of the material can give place to no compensation, refunding or blamed of the responsibility of CutProtect, except in the case of proven hidden defect, nonconformity, defect or exercise of the right of withdrawing.

 

 

Article 8: Not delivered parcels

 

Are concerned parcels not delivered for the following reasons: do not reside, not claimed, refused, damages transport, spoliation...

 

 

 

8.1 - Returns under reason: do not reside

Are concerned parcels returned by the handler in charge of the delivery under the mention: Do not reside.

 

Process

After reception and acceptance of your parcel by our services, we will propose you to send the product initially ordered after having received the amount of the handling fees and of your new address.

 

8.2 - Returns under the reason "not claimed"

 

General information

Are concerned the parcels not claimed by the customers at the post office within the time limits.

Process

After reception and acceptance of your parcel by our services, you can ask for the cancellation of your purchase and its refunding.

 

8.3 - Returns under the "refused" reason

You refused your parcel at the time of the delivery

After reception and acceptance of your parcel by our services, you can ask for the cancellation of your purchase and its refunding under terms of article 9.2.

 

8.4 - Returns under the reason "spoliation"

You refused the parcel because it presented obvious traces of opening and/or shocks

If the parcel is damaged, torn, opened... you must imperatively refuse the parcel and contact our services in order to inform us. If the handler is the Post office, you must request a declaration of spoliation at the moment of the refusal. After reception and acceptance of your parcel by our services, we will propose to you to send a new product as the one ordered or a product with the equivalent characteristics or to cancel your purchase and proceed to its refunding.

 

8.5 - Not distribution

In no case we shall be responsible for non distribution of a parcel by the post office or the handler in the event of a not registered sending. We recommend choosing this option during the ordering.

 

Article 9: Right to change your mind

 

9.1 - Procedure and general conditions of return

 

In an identification process and thus for an optimal treatment of the returns, all of them must be subject of a request of our services, under penalty of being refused. The delay to contact our customer service is fifteen days. The request for return must be made to our customer service which will deliver you an agreement number of return.

 

As of reception of the agreement, you have 15 days to return to us the product. After this period, your return will be refused. We advise you to carry out the return by followed parcel. In the contrary case, if the parcel, send by your care, did not reach us, you would not be able to launch an investigation to the mail service in order to require of them to locate the return. Note that any parcel not sanded by us is not under our responsibility. Only the sender of the parcel is able to ask for an investigation to the mail service. In order to treat your request correctly, thank you to point out your number of order and your complete address to us.

 

Note: When receiving your return, our services will control the conformity of the returned product and the reason for return. If the returned product is not in conformity, it will be refused by our services and will be sent back to you, at your expenses. If your return is returned under a bad reason, your product could be refused and thus be resent to you back at your own expenses. The reason for return could in particular be requalified. Consequently, you will be informed by e-mail and the treatment of your return will be thus according to the new reason.

 

9.2- Returns for withdraw

Methods of return

You have 7 working days from the delivery date of your order to cancel your order, to send back any article not agreeing to you, in his original packaging and in good condition, allowing to its remarketing and to ask for refunding, except for the return and carriage costs. You thus have 7 days to inform us that you wish to retract so that our customer service gives you an agreement number of return.

 

CAUTION: No withdraw will be accepted if the returned product is unsuitable with its remarketing. Consequently:

- the product will have to be returned over in perfect state, in its original packing, non open, not loosened, not damaged, not marked....

- the product will have to be accompanied by all its accessories.

If not, the product will be returned to you, at your expenses.

 

In order to treat your request correctly, thank you to point out your number of order and your complete address to us.

 

Expenses of return for withdraw

The costs of return in the event of withdraw stay at the customer expenses.

 

 

Article 10: Guarantee

 

Guarantee of hidden defects

 

You have a guarantee for hidden defects. Only the products justifying of proven hidden defects can be returned for this reason. The expenses of return of your product will be taken in charge by us. The acceptance of your return will be done after verification of hidden defects by our services. Once your return is accepted by our services, your product will be refunded to you at the purchase price.

The eventual consultancy fees engaged by the customer will not be refunded by our services.

Article 12: Precautions for use

 

Before any use of our product, you must check that the safety device and its fixing is not deteriorated. A minor should not use this product without monitoring of an adult. Our product should not be diverted of its use. In all the cases, the responsibility for CutProtect could not be committed without the respect of these instructions.

 

Article 13: Intellectual property

 

All materials presented on this website, including names, logos, prices, etc., as well as the colour scheme and the layout of the website, are subject to copyright, trademark and/or other intellectual property rights. You may only use these materials, the colour scheme and the layout for your personal, non-commercial purposes. Any other use and/or reproduction of the materials, of the colour scheme, or of the layout of the website, without prior written consent of CutProtect, will constitute breach of these intellectual property rights, and will be prosecuted without further notice.

 

 Article 14: Applicable law and jurisdiction

 

Disputes arising from the use of this website and the interpretation of these CutProtect Terms and Conditions are subject to the laws of the Republic of Slovakia. Disputes will be brought before the Bratislava court. CutProtect reserves the right to institute proceedings in the country of your residence.
